Thank you for choosing Pacifica Studio! We’re dedicated to capturing your special moments with creativity, care, and a personal touch. Please review the policy below—it’s designed to protect your interests as well as ours, and we’ve made every effort to keep it clear and welcoming.

1. Copyright & Usage Rights

1.1. Our Creative Ownership: All images produced by Pacifica Studio are our original work and remain our intellectual property under U.S. copyright law.
1.2. Your Personal License: You receive a non-exclusive, personal-use license to print, share, and display your images for non-commercial purposes. For any commercial use, we’ll happily discuss a separate agreement and licensing fees.
1.3. Watermark & Metadata: All delivered images may include a subtle watermark or metadata identifying Pacifica Studio. Unauthorized alteration or distribution of our work is strictly prohibited.

2. Booking, Payments, and Cancellations

2.1. Changes & Cancellations:
 - Client-Initiated Cancellations: Please notify us at least 1 day in advance to reschedule; your retainer may be applied to a new session.
 - Photographer-Initiated Cancellations: If we must cancel due to unforeseen circumstances, you will be offered a full refund or the option to reschedule at no extra charge.
2.2. Additional Costs: For sessions outside our usual service area, travel and accommodation fees may apply. We’ll explain all additional costs before the session so there are no surprises.

3. Model Release, Privacy & Data Protection

3.1. Consent & Releases: For all sessions—including those with minors—a signed model release is required. A parent or legal guardian must be present and sign on behalf of any child.
3.2. Privacy Commitment: All personal information collected during booking is kept confidential. We comply with California privacy laws (including CCPA) and will not share your data with third parties without consent.
3.3. Portfolio & Testimonials: We value your privacy and want to showcase our work only with your clear approval. Before featuring any images from your session in our portfolio, on our website, or in any promotional materials (including social media or marketing campaigns), we will ask for your explicit permission. If you provide consent in writing or verbally, we may use the approved images as agreed. Only If you explicitly decline, your images will not be used in any promotional context.

4. Liability, Safety, and Artistic Editing

4.1. Your Safety: While we take every precaution during sessions, Pacifica Studio is not liable for personal injuries, property damage, or loss incurred before, during, or after the session.
4.2. Digital Delivery & Backup: Final images will be delivered securely via an online gallery. We maintain backup copies for 24 months following delivery. Let us know if you want to delete them before the expiration date.
4.3. Artistic Direction: All post-production editing is performed at our discretion to preserve artistic integrity. While we welcome feedback, final images reflect our creative vision.

5. Children and Family Sessions

5.1. We are Family-Friendly: We love working with families. For sessions that include children, a parent or legal guardian must be present at all times.

6. Outdoor Sessions

6.1. Permits & Location Fees: For sessions held in locations that require permits—such as public parks or other municipal spaces—the client is responsible for securing all necessary permits and paying any associated fees.
6.2. Rescheduling & Weather Policy: For outdoor sessions, if weather conditions compromise safety or quality, we reserve the right to reschedule at no extra cost.

7. Client Conduct, Professional Standards & Session Termination

7.1. Mutual Respect: We strive to create a welcoming, respectful environment for every session. All clients are expected to interact courteously with our team.
7.2. Disruptive Behavior: If disruptive or aggressive behavior occurs during a session, we reserve the right to pause or end the session immediately. In such cases, no refund will be issued, and we may need to decline future bookings to ensure a safe environment for everyone.
7.3. Professional Collaboration: We’re here to collaborate. If any request conflicts with our creative standards or safety guidelines, we’ll work together to find a mutually acceptable solution.

8. Additional Terms

8.1. Force Majeure: In circumstances beyond our control (e.g., natural disasters, public health issues), sessions may be rescheduled without any penalty.
8.2. Service Modifications: If unexpected issues arise, we’ll work with you to adjust and ensure the best possible outcome.
8.3. Dispute Resolution: We aim to resolve any issues through friendly mediation first. If a resolution can’t be reached, disputes will be handled in California courts.
8.4. Governing Law: This policy is governed by the laws of the State of California.
